Title Shipowners’ Liability Limitation under the ROC Maritime Law in Reference to Liability Limitation on the M/V Amorgos Accident

Summary   This article analyzed the applicability of the shipowners’ liability limitation under the ROC Maritime Law in reference to an accident of M/V Amorgos occurred in south Taiwan coast in 2001. It compared discrepancies between relevant provisions of the ROC Law and international conventions, namely, the Convention on Liability for Maritime Claims 1976, the International Convention relating to the Limitation of the Liability of Owners of Sea-Going Ships 1957 and the International Convention for the Unification of Certain Rules relating to the Limitation of the Liability of Owners of Sea-going Vessels 1924. This article discussed the right of liability limitation, the claims subject to liability limitation, the amount of liability limitation and conducts barring limitation, in order to provide reasonable interpretation of relevant provisions of the ROC Maritime Law and certain suggestions for further modification of the Law.
