| Summary | In order to improve the operation and development of the automobile transportation industry, it is necessary to understand and assist the implementation of the contents of the current insurance scheme (arbitrary liability insurance) for the existing vehicle transport industry, whether it complies with the legislatures and provide adequate protection for the consumers. The study investigated the current policies and future development of Taiwan’s automobile transport industry liability insurance management, and whether the insurance certificate can be used as condition for application for solicitation, while drawing reference from domestic and foreign literatures and national policies from advanced states (e.g. U.S., Germany and Japan, etc) to facilitate discussion on how to strengthen the protection of passenger and cargo transport. The results of the study will be provided to the road transport authorities to develop relevant policies and future measures. The study compiled and sorted information on Taiwan’s current road transport legal system, liability insurance system, and legislations related to Taiwan’s automobile transport liability insurance (e.g. Highway Act, Insurance Act, Compulsory Automobile Liability Insurance Act, National Health Insurance Act and the payment methods for damage compensation and medical subsidy of motor vehicle transport accidents), laying a solid foundation to formulate concrete conclusions and recommendation on issues such as planning for certification of minimal liability insurance and minimal amount of vehicles for the transport industry, while referencing the spirits of the Highway act to tackle the legislative motives for setting high vehicle quantity and capital thresholds. |
