Summary | Nowadays, there are more and more controversies on the separation of power between the central and local governments. Many studies have been carried out at different government offices. However, the laws which regulate transportation activities have been used for more than forty years in Taiwan. Although, they have been amended in words, the original structure and theory remained the same. Hence, they are not appropriate for the new system of local government since the Local Self-Government Regulation has been enacted. Based on the achievements of “Separation of Power on Transportation Affairs between the Central and Local Governments”, published by IOT last two years, this study investigates the scope of power of local self-governments on highway affairs. By reviewing The Constitution of R.O.C., the Local Self-Government Regulation and the theories of self-government, it proposes ten principles for power separation. Then, according to the principles, every highway work is examined, and the suggestions of their power divisions are given at last. We believe that these results will be beneficial for both practical applications and academic researches. |
