Summary | “The United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea”, also known as the Rotterdam Rules, was passed by the United Nations Commission on International Trade Law (“UNCITRAL”) in the year of 2008. About two-thirds of the Rotterdam Rules provisions have not yet been incorporated into the Maritime Act of Taiwan (2009) many of those are controversial in nature, and would require further discussions and adjustments before taking in as part of our future amendment task. The contents of this research include the following four parts: Rotterdam Rules as a reference for future enactment of the Maritime Law of Taiwan. Comparison of Rotterdam Rules with other three international conventions relating to international carriage of goods. Analyses of carriers’ liabilities under Rotterdam Rules. Certain suggestions for future modification of the Maritime Law of Taiwan. This study leads us to review each individual section of the Maritime Law of Taiwan for detailed discussions, and thereafter ends with preliminary proposals for future revisions. |
