| Summary | This research deliberates the Highway Act and its sub-act, the Motor Carrier Regulations, to clarify the enforcement dispute including legal hierarchy of the legal reservation principle, the authority and confliction between central and local governments, and conflicts with other laws (ex. Administrative Penalty Act, Administrative Procedure Act, Consumer Protection Act, and Fair Trade Act, etc.). We reviewed the authorization of motor carriers governing from the Highway Act and the impact of information technology revolution and industry development, and derived the demand of amending the law. We analyzed worldwide regulations of motor carriers, checked national regulations and judgements, collected opinions from governments, experts and industry and other research of the motor carrier management. Finally, we advise amendment of the Highway Act and Motor Carrier Management Regulation. |
