Summary The Administrative Procedure Act went into effect in Taiwan on January 1st, 2001. Via article 163 and article 164 of the law, it is the first time we have definite formal rules in laws to normalize the process of submission for administrative plans. This not only limits the power of authorities but also provides a public participation channel for citizens to directly participate in the decision making of administrative plans. However, so far, it has not been put into practice. For the differences of characteristics among administrative plans, the government has not yet submitted any detail regulations to normalize relative administration actions. Therefore, by surveying the existing decision making process of transportation construction plans, this study attempts to create prime principals for the due process and to establish available norms for the submission process, which will really put public participation into practice. This work, The Due Process of Submission for Transportation Construction Plans﹙Phase Ⅰ﹚, is a pilot study which reviews and integrates the existing submitting process of transportation construction plans and the relative provisions of Urban Planning Law, Environmental Impact Assessment Act and Administrative Procedure Act. According to studies and discussions, it gives a suggestion for the framework of the submitting process of transportation construction plans which is the base for following studies.
